What are the statutory requirement for the Formation of Works Committee under ID Act 1947 ?

In any Industrial Establishment where more than 100 numbers of workmen were employed in any day in preceding 12 months, then a Works Committee shall be constituted. Detail provision is mentioned below:

Statutory Requirement

  • Under Section-3 of Industrial dispute Act, 1947
  • If more than 100 workmen working in Factory, Then Works Committee formation is mandatory.
  • Management Representatives= Workmen Representative Representatives
  • Total Members= Not exceeding 20 No.
  • Term of Chairmanship= Not exceeding 1 Year
  • Chairman shall be changed every year from both Workmen & Management side.
  • Candidates added to the committee should have worked with the company for at least 1 year and should have attained a minimum age of 19 year.

What is Section-3 of Industrial Dispute Act 1947 ?

Under Section 3 of ID act 1947, it is prescribed that if any organization where 100 or more workmen were engaged in any work, then a Works committee shall be constituted, It is Statutory in nature.
